Throughout the site, the terms "we", "us" and "our" refer to TanukiTrade. TanukiTrade offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing any tools, features, or products from the site, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Services are unavailable at any time or for any period. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

The Service is a software platform providing data visualization and analytical tools based on user-defined parameters and automated calculations.

Any information provided through the Service is provided on a general and impersonal basis and is intended for analytical visualization purposes only. Regulatory and risk-related limitations are set out in Section 5 and the Risk and Options Trading Disclaimer.

TanukiTrade provides a technical software environment that enables users to independently analyze market data through automated visualization tools. The Service operates as a neutral technology platform and does not provide financial content curation, editorial market analysis, or regulated investment services.

Section 1 - Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in the jurisdiction where you reside, or that you are the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use this site.

You are responsible for both:

• Making all arrangements necessary for you to have access to the Services.
• Ensuring that all persons who access the Services through your internet connection are aware of these Terms of Service and comply with them.

To access the Services or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the Services that all such registration information you provide to us is correct, current, and complete. You agree that all information you provide to register with the Services or otherwise is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

You agree to notify us immediately of any unauthorized access to or use of your username or account or any other breach of security. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your personal information.

You may not use our Services for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

Section 2 - General Conditions

We reserve the right to refuse Service to anyone at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Service.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

2.1 Contract Formation

The contract is concluded electronically in English. The process includes account registration, subscription selection, and payment confirmation. Users may review and correct data entry errors before completing the purchase. The contract is considered electronically concluded and is stored by TanukiTrade.

Section 3 - Intellectual Property Rights

The Services and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the TanukiTrade, its licensors, or other providers of such material and are protected by European and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Service permit you to use the Services for your personal use, or in your professional capacity. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services, without our express written permission.

You must not:

• Modify copies of any materials from this site, except as otherwise permitted by us.
• Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text, except as otherwise permitted by us.
• Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Services, except as otherwise permitted by us.

No right, title, or interest in or to the Services or any content on the Services is transferred to you, and all rights not expressly granted are reserved by us. Any use of the Services not expressly permitted by these Terms of Service is a breach of these Terms of Service and may violate copyright, trademark, and other laws. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Section 4 - Trademarks

The TanukiTrade name, our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TanukiTrade. You must not use such marks without the prior written permission from us. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

Section 5 – Disclaimers & Regulatory Disclosures

5.1 Nature of the Service

The Service provided by TanukiTrade is a software platform offering analytical tools and data visualization functionality based on automated calculations and user-selected parameters. The Service is provided as software functionality only. The Service does not execute, route, transmit, or facilitate trade orders.

5.2 No Advice; No Personal Recommendation; No Trading Signals

The Service is not intended to provide, and must not be interpreted as providing, investment advice, investment recommendations, personal recommendations, trading signals, or any form of individualized financial guidance. Any information provided through the Service is provided on an impersonal basis and does not constitute a personal recommendation within the meaning of applicable financial regulation.

Any outputs (including metrics, levels, highlights, rankings, labels, or visual cues) are descriptive analytical representations generated automatically and must not be interpreted as:

• (a) instructions to buy, sell, hold, or trade;
• (b) forecasts or predictions; or
• (c) recommendations to enter into, modify, or exit any transaction.

5.3 User Control and Responsibility

Users define the parameters, filters, and configurations used by the Service. TanukiTrade does not assess suitability, appropriateness, profitability, or risk profile for any user. Users remain solely responsible for their own trading and investment decisions.

5.4 Risk Disclosure

By accessing or using the Service, you confirm that you have read, understood, and accepted the Risk and Options Trading Disclaimer.

If you do not accept the Risk and Options Trading Disclaimer, you must not use the Service.

Section 6 - Refund Policy

EU/EEA Consumer Notice (Digital Content / Digital Services)

If you are a consumer resident in the EU/EEA/UK, you may have a statutory right of withdrawal for distance contracts. By starting the free trial or purchasing a subscription, you expressly request immediate access to the digital service and acknowledge that, where applicable under mandatory law, your right of withdrawal may be lost once performance has begun (i.e., once access is granted and the Service is made available to you).

Nothing in these Terms limits any mandatory consumer rights that cannot be waived under applicable law.

Except where mandatory consumer protection law requires otherwise, purchases made through this platform are non-refundable.

By making a purchase, the User expressly waives any right to request or claim a refund, regardless of the circumstances, except where mandatory consumer protection law provides otherwise.

This non-refundability clause shall apply to all products and services offered on the platform and shall be binding upon the User upon completion of the purchase transaction.

By purchasing or starting the Service, you expressly request and consent to immediate performance of the digital service. You acknowledge that once access to the digital content and software functionality is granted, you lose your statutory right of withdrawal pursuant to Section 29 (1) m) of Government Decree 45/2014 (II.26.).

TanukiTrade applies a no-refund policy because we provide every user with a 7-day free trial period, allowing them to try our services at no cost. During this trial period, users can cancel their subscription anytime within the member area provided by Stripe before the first payment or charge is processed. This cancellation will fully stop any future billing or charges.

Additionally, any specific refund terms, if applicable, are detailed in the Frequently Asked Questions (FAQs) or at Checkout on the pages of the various services/products.

While we maintain a strict no-refund policy, we do offer a discretionary partial refund option in special cases if the refund request is submitted within 24 hours of the initial charge.

To be eligible for this goodwill-based exception:

• Your request must be submitted within 24 hours of the transaction, and
• You must present a valid and reasonable justification for the refund.

If approved, we will deduct a Stripe processing fee and administrative handling cost from the original payment, and refund the remaining balance within 5–10 business days.

The applicable deduction amounts are as follows:

• Requests made after the 24-hour window are not eligible, regardless of the reason.

Section 7 - Accuracy, Completeness and Timeliness of Information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for informational and analytical visualization purposes and should not be relied upon as the sole basis for any decision-making without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Section 8 - Nature of the Product / Service

Certain Services may be available exclusively online through the website. We do not warrant that the quality of any Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. Imitations of our Services are not allowed, you agree that we have the right at any time to remove your access and ban you from our server if suspected of imitating in any form.

The Services provided by TanukiTrade constitute a software-as-a-service ("SaaS") platform designed to deliver analytical tools, data aggregation, and visualization functionalities based on market data and user-defined parameters.

The Service enables users to explore, filter, and visualize derived quantitative metrics calculated from publicly available or licensed data sources. Users control the inputs and configurations; the Service only processes and visualizes outputs based on those user-defined settings.

All analytical outputs, labels, metrics, visualizations, rankings, or calculated levels displayed within the Service represent algorithmic or mathematical interpretations of data based solely on predefined formulas and user-selected configurations.

Users retain full discretion and responsibility for interpreting the information presented and for making any trading or investment decisions independently.

The Service is a technical analytics and visualization tool (software functionality).

The Service operates as a neutral technological interface that processes and visualizes data based on predefined algorithms and user-selected inputs. Any outputs generated by the Service are produced automatically without human editorial judgment, qualitative assessment, or market interpretation by TanukiTrade.

Section 9 - Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet; (l) forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Services; (m) "frame" or "mirror" any part of the Services, without our prior written authorization or use meta tags or code or other devices containing any reference to us in order to direct any person to any other service or Web site for any purpose; (n) modify, adapt, translate, reverse engineer, decipher, decompile, separate, or otherwise disassemble any portion of the Services or any software used on or for the Services; (o) attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services; or (p) to interfere with or circumvent the security features of the Services. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

Section 10 - Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet of our site will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data.

We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

You expressly agree that your use of, or inability to use, the Services is at your sole risk. The Services and all Services delivered to you through the Service are (except as expressly stated by us) provided "as is" and "as available" for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Section 11 - Indemnification

You agree to indemnify, defend and hold harmless TanukiTrade and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Section 12 - Changes to Terms of Service

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

Section 13 – Information About You

All information we collect about you is subject to our Privacy Policy. By using the Services, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

Section 14 – Governing Law and Jurisdiction

All matters relating to the Services and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Hungary without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to these Terms of Service or the Services shall be instituted exclusively in the courts of Hungary, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Service in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Nothing in this section limits the rights of EU consumers to bring proceedings in the courts of their country of residence pursuant to Regulation (EU) No 1215/2012.

Section 15 - Options data disclaimer

Our option indicators use market snapshot data provided by OPRA, with a delay of approximately 1-2 minutes during market open hours, to calculate key option metrics. Real-time option contract prices are never displayed via our Web App and TradingView indicators; only derived metrics and interpolated delta are shown to ensure accurate and consistent visualization. This indicator's backend uses artificial intelligence to deliver high-quality and fast data. Consequently, these indicators are intended for analytical visualization and informational purposes only and should not be used as the sole basis for trading decisions.

We reserve the right to make errors. These tools are intended for knowledgeable options traders who can make informed, independent decisions. We rely on third-party data sources and do not guarantee the accuracy, completeness, or timeliness of such data.

Section 16 - Termination Clause

TanukiTrade reserves the right to terminate or suspend your access to the Website and Services at its sole discretion, without notice and for any reason, including but not limited to, breach of these Terms of Service, conduct that the Company believes is harmful to other users, the TanukiTrade, or third parties, or if you are found to be using the Website or Services in a manner that violates applicable laws or regulations. Upon termination, your right to use the Website and Services will immediately cease, and the TanukiTrade reserves the right to remove or delete any information that you may have on file with the Company, including any account or login information.

Section 17 - Free Trial Policy and Restrictions

By starting a 7-day free trial, you agree to the following terms:

• If the trial is canceled during the trial period, all access to our software, indicators, and closed community will be automatically revoked immediately.
• Choosing the "end subscription at the end of trial period" option in Stripe does not entitle you to free usage of invite-only PRO membership benefits after canceling. It only prevents your card from being charged and halts billing at the trial's end.

Fraud prevention:

• All trial requests and subscriptions are logged using IP, TradingView username, email, and metadata.
• Initiating multiple free trials under different email addresses for the same individual (natural person) is strictly prohibited and will result in immediate and permanent account suspension.
• If multiple trials can be traced back to the same individual and have been registered and partially or fully used, the active usage time of these trials will be accumulated. Once the total used trial period reaches seven days, the user authorizes our company to charge an amount equivalent to the most recent trial. In such cases, a refund cannot be requested due to the trial period having already been used in parts. The service agreement can next be terminated at the end of the chosen billing cycle.
• In cases of repeated unauthorized free usage, our company reserves the right to charge a $100/month fee to the provided payment method for each unauthorized month or portion thereof. By using our services, you agree to this policy

Only subscribers with a successful payment will retain access to PRO membership benefits until the end of their paid subscription period.

We ask that you respect these policies and keep in mind that the free trial is a courtesy to help you evaluate our product. Misuse or abuse will not be tolerated.

Section 18- Clarification of Services – "No-Expiration Access"

The TanukiTrade "No-Expiration Access" package is only available to users who have been active subscribers to the TanukiTrade PRO indicator package for at least 30 days. This requirement exists because, according to our internal policy, a user must have a clear and firsthand understanding of the services they are purchasing under the No-Expiration Access model. Since we cannot offer retroactive refunds or partial reimbursements for previously paid subscription periods, it is essential that the user fully understands what is included before committing to a non-expiring access package.

For this reason, we define these terms explicitly and transparently in advance.

While this access is often referred to in the community as "lifetime access," we would like to emphasize that we do not officially support the term "lifetime" in a legal context, as it is not clearly definable in time and may lead to misunderstandings.

The "No-Expiration Access" package means that the user acquires the right to use the TanukiTrade PRO indicator package on the TradingViev platform and the Web App for an indefinite period, linked to a valid TradingView username.

This right:

• does not expire,
• does not terminate even if TanukiTrade's subscription packages change or are discontinued,
• and cannot be revoked, provided the purchase was made legitimately and the user does not violate the terms of use.

This entitlement applies to all current and future updates included in the PRO package, with the same rights as those granted to monthly, quarterly, or annual PRO subscribers — without time limitation.

If the PRO package includes additional services (e.g., Discord access, web app features), the No-Expiration Access holder is entitled to use those services in the same form and duration as active PRO subscribers, but without expiration.

This structure does not allow for misuse but guarantees the user a perpetual right to use the acquired access. However, it does not provide automatic rights to any additional paid services beyond what is included in the PRO subscription. It is important to clarify that "perpetual access" refers to ongoing access to the features and tools included in the PRO package at the time of purchase — and to all future updates to the PRO package — without further payment and without expiration, as long as the TanukiTrade project remains active and operational.

In the event that TanukiTrade, as a service provider, becomes aware of any form of permanent discontinuation or forced termination of the project, all users holding a valid No-Expiration Access license will be notified within 30 days. In such cases, compensation will be calculated by taking the original purchase price of the No-Expiration Access and deducting the value of each started year, based on the current annual PRO plan rate. The remaining balance will be refunded to the user. This process will be handled individually and fairly for each case.

Section 19 – Automated Data Extraction, Scraping, and Unauthorized Data Use

The Services, including but not limited to all data, derived metrics, analytical outputs, indicators, and visualizations made available through the TanukiTrade platform, are provided strictly for personal, non-automated use through the official TanukiTrade interfaces and tools.

Without prior written authorization from TanukiTrade, users are strictly prohibited from engaging in any form of automated or systematic data extraction from the Services. This includes, but is not limited to:

• automated data collection,
• scraping, harvesting, crawling, or spidering of the Services,
• reverse engineering, decoding, or attempting to reconstruct underlying data feeds or calculation methodologies,
• building or operating any independent data feed, API, dataset, or derivative service based on the Services,
• replaying, redistributing, reselling, sublicensing, or otherwise making available any data obtained from the Services to third parties,
• accessing the Services through scripts, bots, headless browsers, automation frameworks, or any other technologies designed to systematically or automatically extract data.

The TanukiTrade Services may only be accessed through the official user interfaces provided by TanukiTrade, including but not limited to the TanukiTrade web application, TradingView indicators, and related tools. The use of automated mechanisms or external systems intended to copy, reproduce, or extract data from the Services is strictly prohibited.

Users accessing the Services under a non-professional usage category may use the Services solely for their own personal analytical purposes. Such users may not use the Services in any manner that would constitute data redistribution, data feed reproduction, commercial data usage, or professional market data usage beyond normal end-user interaction.

TanukiTrade reserves the right, at its sole discretion, to monitor usage patterns and detect automated or abnormal activity. If TanukiTrade determines that a user has engaged in unauthorized automated data extraction, reverse engineering, scraping, or similar activities, TanukiTrade reserves the right to suspend or terminate the user's account and access to the Services immediately, without prior notice and without refund.

Furthermore, certain market data displayed or used within the Services may be subject to licensing terms of third-party data providers, including but not limited to the Options Price Reporting Authority (OPRA). Unauthorized automated extraction or redistribution of such data may be considered professional market data usage under applicable exchange or data provider rules. In such cases, TanukiTrade reserves the right to report suspected misuse to the relevant data providers or regulatory bodies, and the user may be held responsible for any resulting professional data licensing fees, costs, or other liabilities.

By using the Services, the user acknowledges and agrees that any attempt to systematically extract, reproduce, redistribute, or commercially exploit the data provided by TanukiTrade constitutes a material breach of these Terms of Service.

Section 20 - Consumer Complaint Handling

TanukiTrade will acknowledge complaints and respond within a reasonable timeframe, typically within 30 days.
